| Site Operator | Novae LLC |
| Website | Novaepayments.com |
| Purpose: This disclosure allows an applicant to receive, review, sign, and retain merchant-application records electronically. The Site operator only receives or facilitates the application and passes it to the processor and related underwriting parties; it does not approve merchants or provide payment processing. |
This Electronic Communications and E-Sign Disclosure and Consent (“Consent”) applies to your use of https://novaepayments.com/ to request information, complete or submit a merchant application, upload requested documents, and communicate about the application. “Company,” “we,” “us,” and “our” mean Novae LLC doing business as Novae Payments. “You” means the individual applicant and the business or legal entity for which that individual acts.
Please read this Consent carefully and retain a copy. By affirmatively accepting it, you agree to conduct the application process electronically and to use electronic records and signatures as described below.
1. Company’s Limited Role
Company operates the Site solely as a white-label referral and merchant-application intake partner. We receive or facilitate the collection of application information and pass it to Lacore Enterprises, LLC, Payfacto, Inc. and/or Community Federal Savings Bank, Member FDIC, and providers they use for identity verification, underwriting, compliance, onboarding, and related services (“Processing Providers”).
Company does not make underwriting or approval decisions, establish reserves, process transactions, hold or settle funds, determine funding timing, or manage chargebacks. Processing Providers may require you to accept separate electronic disclosure, signature, privacy, and merchant-service terms. This Consent does not replace a Processing Provider’s required consent.
2. Scope of Your Consent
You consent to receive, access, review, sign, and retain electronically all records that Company provides or facilitates in connection with your inquiry or merchant application (“Electronic Records”), including:
this Consent, the Website Terms and Conditions, Privacy Policy, cookie or privacy notices, and later updates;
merchant inquiry and application forms, beneficial-owner or control-person certifications, authorizations, attestations, and uploaded documents;
requests for additional information or documentation and application-status communications;
identity-, bank-, tax-, credit-, background-, fraud-, and verification authorizations or disclosures, where applicable and separately presented;
pricing proposals, equipment or software information, program descriptions, and preliminary offers;
agreements, schedules, disclosures, notices, policies, and communications delivered through or on behalf of an applicable Processing Provider, but only where Company is authorized to facilitate that delivery; and
records evidencing your consent, acceptance, signatures, submissions, and communications.
This Consent applies to the current inquiry and application and related application communications. It does not automatically govern every record in an approved merchant relationship unless the applicable Processing Provider expressly adopts this Consent or obtains a separate consent.
3. Electronic Delivery Methods
Electronic Records may be presented on the Site, in an application portal, by email, through a link in an email or text message, as a downloadable PDF or other supported file, or through another electronic method disclosed during the application process. You should download or print each important record when it is presented because links and portal access may expire.
4. Electronic Signatures
You agree that clicking an “I Agree,” “Accept,” “Continue,” “Submit,” or similar button; checking an acceptance box; typing your name; drawing or uploading a signature; entering a verification code; or taking another electronic action identified as a signature or acceptance constitutes your electronic signature when linked to the applicable record.
You intend your electronic signature to have the same force and effect as a handwritten signature to the extent permitted by law. You represent that you are authorized to sign for the applicant business and that the information and documents you submit are complete and accurate.
5. Hardware and Software Requirements
To access, review, sign, download, and retain Electronic Records, you must have:
a computer, smartphone, tablet, or similar internet-enabled device;
a current, supported web browser with cookies and JavaScript enabled and transport-layer security supported;
reliable internet access and a current email address that you can access;
software capable of opening and displaying PDF files and any other file format disclosed during the application;
sufficient device or cloud storage to download and retain Electronic Records; and
a printer if you want paper copies.
By accepting electronically, you confirm that you can access this Consent in the electronic form presented, can read it, and can download, save, or print it. If you cannot access or retain this Consent, do not accept it; contact us using Section 11.
6. Paper Copies
You may request a paper copy of an Electronic Record provided by Company by contacting us using Section 11 and identifying the requested record. Company currently does not charge for a reasonable number of paper copies, but you are responsible for delivery charges, if any, that are disclosed before fulfillment. Processing Providers may have separate paper-copy procedures or fees under their documents.
Requesting a paper copy does not automatically withdraw your consent to electronic delivery.
7. Withdrawing Consent
You may withdraw this Consent for future Electronic Records by contacting us at
Withdrawal does not affect the validity or enforceability of Electronic Records or signatures provided before the withdrawal became effective. If you withdraw before the application is completed, we may be unable to continue the electronic application. A paper or alternative process may not be available through Company; you may need to contact the applicable Processing Provider. Company does not charge a withdrawal fee.
8. Updating Contact Information
You must keep your email address, telephone number, and other electronic contact information current. Update your information by contacting
9. Changes to Technical Requirements
If a change to hardware or software requirements creates a material risk that you cannot access or retain later Electronic Records covered by this Consent, we will provide notice of the revised requirements where required. The notice will explain how to withdraw consent without a fee or a new consequence that was not previously disclosed. We may ask you to confirm consent again in a manner demonstrating access to the new electronic format.
10. Record Retention and Evidence
Company may retain electronic evidence of the application process, including the version of each record presented, timestamps, acceptance events, signature data, IP address, device or browser information, delivery information, and related audit records, in accordance with the Privacy Policy, contractual requirements, and applicable law. Processing Providers retain records they receive under their own policies.
An electronic copy that accurately reflects a record and can be reproduced for later reference may be treated as an original to the extent permitted by law.
